I take bids on mowing here at the plant every year, this year I changed mowers. The guy from last year insists that he had a two year contract to mow. I did not sign anything, nor did I even verbally agree to a 2 year deal. He did, however, list "two year contract" on his invoices when he sent them in. Now the dumbass is trying to bill me every time this other guy mows the lawn and is threatening legal action...

Normally if there is no written contract for services, it is looked at by the courts as a ONE year contract, with monthly extensions if no new agreement is made. But, in this case, you had the guy listing it as a 2 year deal on the invoices which might be looked at as your acceptance of his terms of the contract. Do you have any documentation of your request for bids in which you say it is a one year bid, or that no mention of the term of the contract will be. There are other factors too, but I will not overload you with to much at first.
I did cross out the "two year contract" on each invoice before I signed off on them last year. I just sent him a letter asking for a copy of the two year agreement, otherwise I consider the issue closed. I should be hearing from him anyday now and don't really want to get the company's lawyer involved if it isn't necessary....you guys are too damn expensive...(plus the fees count against my budget)
