yeh see that's the rub - I bet anything they think they could successfully argue 1) you are a quasi-independent contractor and 2) you signed away your rights.
Both of which are probably bullshit in your state just like they are in most. Everyone tries to get us to sign waivers and the like to "knowingly" sign away our rights. And generally when challenged in court it always comes back to the fact that the contract they made you sign was illegal because it violated the (labor) laws of the land and therefor you could win in court. BUT people rarely ever pursue. Why would you wnat to if you like your job right? And people rarely complain to management - for the same reason.
One thing that occurs to me though - you live in New Jersey - I assume you're working there?
Nevada has different labor laws than other states because of the dominance of the gaming industry and how they want those casinos to operate. It's just not practical always to have things run like a factory when you're in the business of entertainment.
I wouldn't be surprised that New Jersey has some fucked up exemptions to labor law because of laws the gaming industry got passed.
