This will get eBay staff involved in the arbitration. Also, print off the auction listing, and emails, and the receipt for your check/verification it was deducted from your account.
You can sue him in small claims as an eBay purchase is a legal contract, it is very very easy to win those cases if you keep your proof.
But before suing, try out the eBay dispute console. I have been involved with eBay in various degrees since '99 and have had to use the dispute service twice. Both times they helped me receive my items.
But as others have said, use paypal from now on. I've had to dispute one thing since signing up for paypal and I did it through the paypal dispute service. Paypal reversed my payment and returned my money to me, piece of cake.
