New York's cigarettes are the most expensive in the U.S. Lawmakers passed what we expect to be Governor Paterson's second to last extender bill. And that paves the way for cigarettes here to cost $9.20 a pack this July. But that's not even the most controversial part of this legislation. Erin Billups has more.
ALBANY, N.Y. -- The Democratic-led state legislature approved the governor's 23-percent cigarette tax hike.
"It's really hard to defend cheap cigarettes," said Senator Diane Savino.
Tax on a pack of cigarettes come July will go from $2.75 a pack to $4.35 making taxes on cigarettes in New York City a whopping $5.85.
In August, the tax on snuff will go from 96 cents to $2 per ounce and on September 1, the state will start enforcing tax collection on cigarettes sold on Native American lands, probably the most controversial measure in the bill that several lawmakers opposed.
"We are on their land, and I think it's wrong to tax Native Americans. I'm going to vote for this because I don't want to shut down government," said Senator Eric Adams.
Republicans, though, argue the bill wasn't directly linked to the emergency spending bills and those who were against it should have voted their conscious.
"This is just a piece of the rest of the piecemeal budget process and if its rejected government is still going to operate," said Senator John DeFrancisco.
The bill forces cigarette manufacturers to pay for taxes before cigarettes are distributed to Indian reservations. Native Americans would be reimbursed through a coupon system.
"We can make sure that when a Native American wants to buy a pack of cigarettes they're entitled to buy it tax free, but no one else," said Senator Jeff Klein.
Meanwhile tobacco lobbyists argue the bill sets a dangerous precedent giving the governor too much authority to negotiate with tribes.
"It gives the governor the unprecedented power in this bill to settle a case without legislative approval, not just settle any case, but settle in a way that would change the law as it relates to Native American tax collection going forward," said Joe Murillo with Altria.
Lawmakers though say any agreement the governor makes with tribes must still be approved by the Legislature.

When I used to smoke, I would buy them online from Russia. I think it came to $10/carton. I smoked Salem's and the blends are different sent overseas. I smoked for over 20 years and nothing comes close to these!!
